COVID-19 Policies Concerning Public Auctions of Foreclosed Property

The auction will be held at St. Lawrence County Courthouse: 48 Court Street, Canton, NY 13617 in the Courthouse Lobby.

Interested bidders are encouraged to pre-register for this auction in order to ensure that the auction occurs in a sufficiently sized room by contacting the Referee at Tadams@cmbk.com no later than 2 days before the sale.

Temperature Screening and Questioning: All who attend that auction, including the referee, bidders, and spectators, will be required to submit to temperature screening and questioning upon entering the courthouse. Uniformed officers use touchless infrared thermometers and ask the following questions of all who enter:

Within the past 14 days, have you:

  • Had a fever, cough, shortness of breath or flu-like symptoms?
  • Tested positive for COVID-19?
  • Been in close contact with someone who has tested positive for COVID-19?
  • Been directed to quarantine, isolate or self-monitor at home for coronavirus by any doctor, hospital or health agency?
  • Returned from travel abroad or form a State on the advisory watch list?
  • Been in close contact with anyone who has been outside the country or in a State on the advisory watch list?

Anyone whose temperature is equal to or greater than 100 degrees or who answers “Yes” to any of the above questions will not be permitted entry and will be unable to participate in the auction in-person. However, such individuals may either retain an agent to appear or their behalf (the agency designation much be in writing, suitable acknowledged and presented to the referee at the outset of the auction, or make application to the assigned judge to stay the sale, on notice to the referee and all other parties who appeared in the action and did not waive notice.

Face Covings: Face coverings are required for all who enter the courthouse. Those who appear without a face covering will not be permitted entry and will be unable to participate in the auction. Accommodation are available for those who are medically unable to wear a face covering. Impacted persons should contact the Chief Clerk of the Court in advance of the action date.

Ensuring Health and Safety: Court Officers will be assigned to the auction part and will be responsible for enforcing all Court System health and safety policies, including room density limits.

Exceeding Density Limits: On the day of sale, if the number of bidders exceeds the density limits of the designated auction room, every effort will be made by the clerk assigned to the auction part to move it to an alternate location, right then and there. All participants shall maintain appropriate social distancing during the auction and shall comply with any face covering rule, regulation, or order in effect at the time of the auction. The Referee shall refuse to accept any bid placed by a bidder not complying with this requirement. Should the Plaintiff’s agent fail to comply with this requirement, the Referee shall cancel the auction, and advise Plaintiff’s counsel of the reason for the cancellation. Should the Referee cancel the auction due to the Plaintiff’s agent’s failure to comply with this requirement, Plaintiff shall not recover any subsequent re-publication costs.

Closing and Deed Transfer: Following the auction, the successful bidder will either complete the sale in the auction room or, if the Terms of Sale allow, deposit at least 10% of the sales price with the referee at the close of the sale. In the latter instance, the balance of the funds, along with transfer of title documents will occur at the office of the referee within the time limits specified in the terms of Sale. All participants in the closing must comply with any face covering rule, regulation, or order in effect at the time of closing. Should a bidder fail to comply, the Referee may cancel the closing and hold the bidder in default.
